Help for the falsely accused of domestic violence
Hello. My name is Leslie Williams, founder and president of Advocates For The Falsely Accused (AFTFA) in domestic violence - a nonprofit organization dedicated to supporting, educating, and preventing one from being accused of domestic violence through education and how to prevent being convicted for domestic violent crimes that you DID NOT commit. My ex-wife falsely accused me of domestic violence. Her allegations were:
1. I yanked her back into our home, once inside I held her to make her talk! What I did not know was she planned the event as it was recorded on our “RING” camera!
2. I threatened to kill her!
3. I restrained her from contacting police.
4. I threatened to hit her with a pot.
5. I punched a hole in the wall past her face.
6. There were more false allegations.
My ex-wife contacted Hernando County Sheriff’s office, while I was playing golf, I got an alert on “Ring” it was the Hernando County Sheriffs wanting to speak to me! I advised them I would return in 2 hours. Once I returned, I called them, they asked what my intentions were when they arrived stating there was video which shows me holding her and begging her not to end our marriage, I also said don’t do this, I love you and I know you love me too, she said no I don’t, let me go, and I did! The Sheriff’s officer said she was claiming abuse, but he did not see any, he saw a man trying to convince his wife!
An injunction was filed by her with the court (family), she also completed an application with the “Dawn Center” there adding to her claims of my domestic abuse, and their support of her in the court room! There we were in the courtroom, sworn in, the judge gave my ex the opportunity to speak on her claim, asking for a copy of the video that I never saw, never knew existed. He played it, I heard my voice saying what I described earlier. The judge asked, “where is the video of him yanking or pulling you back inside, is there another video?” There wasn’t as it never happened!!!! My turn came, I explained to the judge, I had no idea what was going on as I was yet processing her all of a sudden desire to end our marriage. I advised the same as I did with the Sheriff’s.
Each allegation of domestic abuse or violence were refuted by me line by line stating after each allegation, “and there were no police called as it never happened!” The judge dismissed her case and injunction stating there was no aggression whatsoever.
Her injunction requested:
1. I be removed from my home which meant:
a. Loss of businesses and income as businesses are headquartered on property
2. That I remain 500 feet away from her at all times
3. Financial support
Her hope was for me to be remanded in county custody on arbitrary accusations. If the judge would’ve believed any of her false accusations, I would’ve lost:
1. Freedom
2. Businesses
3. Ministry
4. Reputation
5. Trust
6. My home
It is clear how false accusations of domestic violence can hurt and harm the accused innocent person. Although her injunction was dismissed, I have felt the pressure of rumors which is why there must be prosecution of the false accuser. This consequence might discourages false accusations and support those who would become victims of false accusations leveled against them.
I was blessed that I wasn’t incarcerated, but many are fighting now for their freedom, that’s why AFTFA was created so they and we are not fighting alone! It is my desire to ensure the law is changed or amended and that false accusations of domestic violence be called a crime and for perpetrators of it to serve jail time. Here at AFTFA, we don’t want anyone going through the mental anguish, the embarrassment, or the destruction of reputation and destruction of families by those who would levy false accusations against others.
Our mission is to have the law changed or amended where false accusers of domestic violence are prosecuted and receive the same judgment the falsely accused would have received if convicted!
Our vision is to have a country where the innocent accused of domestic violence have the support of law enforcement, the court system and the state as a victim of a crime.
We are a charitable organization dedicated to serving those who were falsely accused of domestic violence. Our mission is to have the law changed or amended where false accusers of domestic violence are prosecuted and receive the same judgment the falsely accused would have received if convicted! Furthermore to provide support, education, and proper litigation whether male or female.
If there is anything that recent headlines have taught us, is that domestic violence is terrible, demeaning and inhumane. No one should have to endure any type of abuse , and no one should feel comfortable with physically hurting someone they are supposed to love! Additionally, we learned that domestic violence does not discriminate, it respects no boundaries of gender, race, or religion, male or female. Sad to say there are over 1,000,000 cases of false domestic violence or abuse charges in the U.S. Anyone can be falsely accused of domestic violence which can fracture, tarnish or destroy the name of the accused, their reputation personal/business. A false accusation can cause close family members to distrust ti=he falsely accused which can ;leave them without a support system. Even when innocence has been determined and the petition’s charges are dismissed, the fact that domestic violence has been associated with your name can be very hard to overcome! .
Being falsley accused of domestic violence has a lasting stigma although dismissed it can be difficult to shake, and it may take a long time to restore one's reputation. The accused is at the total mercy of law enforcement and the court system. There are laws that make it a crime to report false information, but rarely enforced. Some of those F.S. are listed below:
Florida Statute Section 817.49 states it is a criminal offense to knowingly give a false report regarding a crime that did not occur. The first offense of giving a false statement of a crime is a first-degree misdemeanor and carries penalties to one year in jail or one-year probation and a $1,000 fine.
Florida Statute Section 837.05, states it is a criminal offense for a person to knowingly give to a law enforcement or police officer false information regarding the commission of a crime.
Florida Statute Section 817.49, states False Report of a Crime, or ‘False Police Report,’ occurs where a person makes a willful allegation to law enforcement regarding the commission of a crime, while knowing that no such crime has occurred. The offense carries misdemeanor penalties, including up to 1 year in jail. Under the law, it is a criminal offense for a person to willfully and knowingly give false information or make a false report regarding the commission of a crime that the person knows did not actually occur.
First Offense Penalties If Convicted Of Domestic Violence In Florida
Criminal County Courts in Florida handle cases that involve misdemeanor criminal charges. A criminal charge, punishable by one year or less of prison time, is considered a misdemeanor. In Florida, if you are convicted of Domestic Violence Battery, the penalties include:
The penalties you could face will be decided by the judge presiding over the criminal case in a Florida criminal County Court and could increase with a second or third offense. The judge could also approve a request for imposing a domestic violence injunction, commonly known as a restraining order. If ordered, this injunction can restrict how and when you can have contact with the other party. Also the injunction can have a more devastating effect in that you can be restricted from your business if shared or on your property!
As you can see the penalties for the falsely accused can be devastating and costly in comparison to even the first offense of domestic violence! The laws have to be changed or amended to level the field of justice, AFTFA is dedicated to making it a crime to report false domestic violence in the state of Florida, punishable by a maximum of 1 year in prison, maximum of 1 year of probation, a maximum of a $1000.00 fine! This matches the penalty for first time offenders of domestic violence and we believe it will lesson the desire to make the false accusation or perform a physical act upon oneself.
